This recommendation is rejected. The operator already has a clear responsibility under Reg 76 and 141 to ensure that the pilot is competent to carry out the particular type of operation that they are engaged in. In this case this did not occur. It is irrelevant that this pilot was a part time employee.
While reference has been made to a FAA study, we found that the FAA has not made regulations to change the annual check requirements.
